Privacy Policy

1. Who We Are
FranchiseAgent is a product operated by HummingAgent ("we," "us," or "our"). We provide AI-powered phone answering, intake, and routing services designed for franchise systems and multi-location businesses. This Privacy Policy explains how we collect, use, share, and protect information when you visit franchiseagent.ai (the "Site") and when calls are handled through our voice service (the "Service").

2. Information We Collect on the Site
When you visit the Site, we collect:
- Information you provide directly, such as your name, email address, company name, and any details you share when you contact us by email or book a call through our scheduling provider.
- Usage information, such as pages viewed, referring pages, approximate location derived from IP address, browser type, device type, and access times. This is collected through standard server logs and, where enabled, privacy-conscious analytics.
Scheduling a call through our booking link takes you to a third-party scheduling provider. Information you submit there is also governed by that provider's own privacy policy.
3. Information We Collect Through the Voice Service
When the Service answers calls on behalf of a franchise system or business client, we may collect and process:
- Caller phone number, the number dialed, and call metadata such as date, time, duration, and routing outcome.
- The audio of the call, which may be recorded, and transcriptions of the call generated for intake, routing, quality assurance, and summary purposes.
- Information the caller chooses to share during the call, such as their name, contact details, location, and the reason for calling.
Disclosure to Callers
Callers are informed at the start of a call that they are speaking with an AI assistant. Where calls are recorded or transcribed, callers receive notice consistent with applicable law. Callers who do not wish to speak with the AI assistant can be routed to a human or another contact channel where the client has configured one.
4. How We Use Information
- To answer, route, and summarize calls as configured by our clients.
- To provide, maintain, secure, and improve the Site and the Service.
- To respond to inquiries, schedule consultations, and communicate with clients and prospective clients.
- To monitor quality, refine intake configurations for a specific client, and troubleshoot issues.
- To comply with legal obligations and enforce our terms.
We do not sell personal information, and we do not use the content of our clients' calls to build advertising profiles.
5. How We Share Information
- With our clients. Call recordings, transcriptions, and summaries are shared with the franchise system or business the caller intended to reach, including the relevant location owner and, where configured, the franchisor.
- With service providers that support our infrastructure, such as cloud hosting, telephony, speech processing, and analytics vendors, under contracts that restrict their use of the data.
- For legal reasons, when required by law, legal process, or to protect the rights, safety, or property of callers, clients, the public, or HummingAgent.
- In a business transfer, such as a merger, acquisition, or sale of assets, subject to this policy or one that is at least as protective.
6. Data Retention
We retain Site inquiry data for as long as needed to respond and maintain our business relationship. Call recordings, transcriptions, and summaries are retained according to the service agreement with the relevant client and are deleted or de-identified when no longer needed for the purposes described above, unless a longer period is required by law.
7. Security
We use administrative, technical, and organizational safeguards appropriate to the nature of the data, including encryption in transit, access controls, and vendor due diligence. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
8. Your Rights and Choices
Depending on where you live, you may have rights to access, correct, delete, or receive a copy of your personal information, to object to or restrict certain processing, and to withdraw consent where processing is based on consent. To exercise these rights, contact us at hello@hummingagent.ai. We will verify your request and respond within the time required by applicable law. If your request concerns a call handled for one of our clients, we may direct the request to that client or assist them in responding, since they determine the purposes of that processing.
9. Children's Privacy
The Site and the Service are intended for business use and are not directed to children under 16. We do not knowingly collect personal information from children. If you believe a child has provided us personal information, contact us and we will delete it.
10. International Transfers
We are based in the United States and process data there. If you access the Site or place calls from outside the United States, your information may be transferred to and processed in the United States, where data protection laws may differ from those in your jurisdiction. Where required, we use appropriate safeguards for such transfers.
11. Changes to This Policy
We may update this Privacy Policy from time to time. When we do, we will revise the effective date above and, for material changes, take reasonable steps to provide additional notice. Your continued use of the Site or the Service after changes take effect constitutes acceptance of the updated policy.
